Probate, Letters of Administration & Deceased Estate Administration
Whitsundays
Losing a loved one is an emotional and often overwhelming experience—especially when you're also responsible for managing their estate. If you're named as the executor of a Will, or if there is no Will and you're the next of kin, you may need to apply for either Probate or Letters of Administration before any assets can be distributed. At Airlie Legal, we support individuals and families across Queensland through the legal process of estate administration.
What Is Probate?
Probate validates a deceased person's will, enabling the executor to distribute the estate. Without it, banks and institutions won't release funds or transfer property. Airlie Legal manages the entire application process, from document preparation to court filing.
Who We Help
When someone dies with a valid will, the executors apply for a grant of probate. This is the Supreme Court’s way of officially recognising the will, allowing executors to manage and distribute the deceased’s estate.

Types of
Grants
Grant of Letters of Administration of a Will
Used when there is a valid will, but the person applying isn’t named as an executor. Once approved, this person becomes the administrator.
Grant of Letters of Administration on Intestacy
Used when there is no valid will. The appointed person manages the estate according to intestacy rules.
In Queensland, probate is usually necessary, but there are exceptions, such as:
- Limited cash in the estate
- Property to be transferred to a beneficiary
- Real estate to be sold
Even in these cases, getting probate is recommended to protect the executor from personal liability. Most banks, super funds, and financial institutions require probate to release funds or transfer property.
Losing a loved one is incredibly difficult. At Airlie Legal, we guide you through obtaining a Grant of Probate from the Supreme Court of Queensland with sensitivity and care, making the process as smooth as possible.

What Is Estate Administration?
A deceased estate includes the property and assets of a person who has died, such as real estate, money, and personal possessions.
If someone passes away without a valid Will, they are said to have died intestate. In this case, Letters of Administration must be obtained. This is a similar court process that appoints someone (usually the next of kin) as administrator of the estate, giving them the legal authority to act on behalf of the estate.

Who We Help
Estate administration involves managing and distributing a deceased person’s assets, paying off debts and taxes, and distributing the remaining assets to rightful beneficiaries. This process can be complex and emotionally challenging, especially for those unfamiliar with legal and financial matters.
The executor named in a will must apply for a Grant of Probate, manage the estate, pay debts, and distribute assets to beneficiaries. Due to the complexity of this role, having an experienced estate lawyer from Airlie Legal to guide and assist is essential.
Airlie Legal can help you carry out your duties in a timely manner, providing peace of mind to you and any beneficiaries. If you’re in a situation where a deceased person has not left a will, we can guide you through the process of administering the estate according to Australian intestacy law.
